Mariano Ayuso Ruiz-Toledo, magistrate of Contentious Court on leave of absense and Ayuso Legal office Director, gave a very interesting speech in which he explained the concept and legal characterization of the Commercial Agent.

He spoke about the Agency agreement and of the rights and duties of the Commercial Agent in this agreement.

He explained the Payment on a commission basis of the Commercial Agent for the events and transactions concluded during the term of the Agency agreement, as well as the remuneration by broker’s Commission for transactions concluded after the termination of the agency contract.

After that, he spoke about the contract extinction and the compensation that Agent has the right to when the agency agreement expires.

To finish up, he talked about being a member of this kind of Associations like COAC Valencia and how to do it, pointing out that membership is compulsory (under 511 epigraph of business tax). Associations are regulated by Royal Decree- Law 118/2005 of February 4.

His speech clarified many doubts about legal and contractual aspects of the profession of Commercial Agent, emphasizing the obligatory nature of being part of this kind the Association for practising the profession under 511 epigraph of business tax.
